Administrative and environmental law

Government intervenes in the lives of citizens and businesses in numerous ways, even where our physical living environment is concerned. For example, in this case it would involve municipal zoning plans and provincial by-laws governing spatial planning, as well as the Buildings Decree [Bouwbesluit] 2012, the Housing Act [Woningwet], the Spatial Planning Act [Wet Ruimtelijke Ordening], and the new Environment and Planning Act [Omgevingswet] and Housing Regulations [Huisvestingsverordeningen].

The Netherlands is one of the most densely populated countries in the world. As such, it is not strange that problems occur and disputes arise between citizens and government with considerable regularity in relation to the use of space and land.

Clairfort has extensive experience of administrative law, especially where zoning and the use of property and land is concerned. Clairfort can be of service to you in relation to zoning plans, environmental permits, and opinions on and appeals (also to higher tribunals) against them. Regulatory or market regulation law

Regulatory (or market regulation) law is the name for the administrative law governing a specific sector, such as the rules stipulated in the Pension Portability Act 2000, the Environmental Management Act and the Health Care (Market Regulation) Act. Clairfort is a specialist in the regulatory fields of the health, public transport, agriculture, fishery, waste management and education sectors. In those sectors it provides advice on competition, regulation and administrative law (procedural or otherwise).

Tendering

Clairfort represents water boards, housing corporations, and provincial and municipal councils in relation to tender disputes and advises those public authorities on major project tendering.
